§ 26-204. Final plat.

  • (a)

    Required; prerequisites for submission; prerequisites for recording. As the third step in the plat review procedure, the subdivider shall submit a final plat. Submission of the final plat shall be required, and no improvements, including streets, shall be accepted and maintained by the town unless and until the final plat has been approved by an engineer and the town commission and duly recorded by the clerk of the county circuit court. Before submitting the final plat for review by an engineer and the town commission, the subdivider shall have met all the requirements of division 3 of this article. The clerk of the circuit court shall record only those final plats which have been approved in accordance with this article and submitted for recording by an engineer.

    (b)

    Application procedure; time limit for application.

    (1)

    The subdivider shall submit as the final plat only that portion of the approved preliminary plat which the subdivider proposes to record and develop at the time. Such portion shall conform to all requirements of this article.

    (2)

    The subdivider shall submit eight copies of the final plat to the planning and zoning board. Two copies of the final plat shall be drawn or printed on linen, cronaflex, mylar, or other similar durable material for recording by the county clerk of the circuit court.

    (3)

    Failure to apply for final plat approval within one year of preliminary plat approval shall result in the revocation of the preliminary plat approval. A time extension may be granted if it is approved by the town commission.

    (c)

    Required information and exhibits. Prior to submission of the final plat for review and approval, the owner or his agent must acquire a certificate of concurrency from the town building official. This certificate must be submitted with the final plat before a review will be conducted by the town engineer. The final plat shall be prepared by a currently registered surveyor or a professional engineer at a scale of 100 feet to one inch. Specifically, one linen tracing or equal, indicating streets, lots, blocks and easements of the proposed subdivision, shall be prepared in accordance with F.S. ch. 177. The tracing shall be 24 inches by 36 inches, including a three-inch binding margin on the left side, and a one-inch margin shall be provided on the other three sides. In addition to the tracing, one cloth print and two paper prints shall be submitted after the original has been approved. The following information shall be shown on the final plat or on a sheet attached thereto. Prior to submission of the final plat for review and approval, the owner or his agent must acquire a certificate of concurrency from the town building official. This certificate must be submitted with the final plat before a review will be conducted by the town engineer.

    (1)

    General information.

    a.

    The name of the subdivision, and the name, address, and telephone number of the subdivider, subdivision designer, professional engineer and registered surveyor.

    b.

    The date of survey and final plat preparation, north point and graphic scale.

    c.

    The names and locations of adjoining subdivisions and streets and the names of abutting property owners.

    d.

    The names and addresses of mortgagees of the property.

    e.

    Deed restrictions or protective covenants for the subdivision, if any.

    f.

    A certification that taxes are paid as assessed by the assessor or a receipt for taxes paid as assessed by the assessor.

    g.

    The name and address of all parties owning a legal or equitable interest in the land.

    (2)

    Survey data.

    a.

    Town limit lines (if any), property lines, rights-of-way, easements, streets, railroads, utility transmission lines, storm sewers, ditches, and culverts, sanitary sewers, water mains, bridges, buildings, bulkheads and bulkhead lines.

    b.

    Accurate location and legal description of all monuments, markers, and control points.

    c.

    Sufficient engineering data to determine readily and reproduce on the ground every straight or curved boundary line, street line, lot line, lot acreage, right-of-way line, easement line, and setback line, including linear dimensions, bearings or deflection angles, radii, arcs, and central angles. All dimensions shall be measured to the nearest 1/100 of a foot and all angles to the nearest second.

    (3)

    Site data.

    a.

    All rights-of-way, easements, and areas to be dedicated to public use, with the purpose of each stated.

    b.

    Areas to be used for purposes other than residential and public, if any, with the purpose, location and dimensions of each indicated.

    c.

    Lot and block numbers and street names.

    d.

    Bulkhead lines.

    e.

    Such cross sections and profiles of streets as required.

    f.

    Such engineering plans and drawings for water, sanitary sewers, and storm sewer systems, showing sizes, cross sections and profiles, as required.

    g.

    A stormwater management plan prepared in accordance with the interim performance and design standards specified in article VIII of this chapter.

    h.

    Such engineering plans and drawings of bulkheads, bridges, and sidewalks, if any, showing cross sections and profiles, as required.

    i.

    Plans for improvements proposed to be erected on the property.

    (4)

    Signed certificates. Signed certificates as exhibited in the appendix to Ordinance No. 00-11-1.

    Editor's note— The appendix referred to in the above subsection is not printed herein.

    (5)

    Additional exhibits. Such additional exhibits as may be required by F.S. ch. 177.

    (d)

    Review and action by planning and zoning board.

    (1)

    The planning and zoning board shall review the final plat within 30 days of the date such plat was submitted. The planning and zoning board shall refer such final plat to the building inspector and other appropriate departments within this 30-day period.

    (2)

    If the final plat meets all requirements of this article and complies with the approved preliminary plat, the planning and zoning board shall approve the final plat.

    (3)

    When approved by the planning and zoning board, the final plat shall be referred to the town commission for final review.

    (4)

    If the final plat is disapproved by the planning and zoning board, within 30 days, all reasons for such action shall be specified in writing, and reference shall be made to the specific provisions with which the final plat does not comply. One copy of such reasons shall be retained by the planning and zoning board, and the other copy shall be given to the subdivider. The subdivider may make the recommended changes and resubmit the final plat to the planning and zoning board.

    (e)

    Review and action by town commission; recording.

    (1)

    The town commission shall review and take action on the final plat within 45 days after it receives the final plat.

    (2)

    If the final plat meets all the requirements of this article and is in accordance with the approved preliminary plat, the town commission shall approve the final plat if allowed by law, rule, regulation or order, and indicate its approval on each copy by signature of the chairperson. When approved by the town commission, the approved final plat shall be forwarded to the planning and zoning board chairperson, who shall file the approved final plat with the county clerk of court within ten days after the date of its approval by the town commission. The planning and zoning board chairperson shall notify the subdivider and all department heads that the final plat has been recorded.

    (3)

    If the final plat is disapproved by the town commission, the reasons for disapproval shall be stated in writing, and reference shall be made to the specific provisions with which the final plat does not comply. A copy of such reasons shall be sent to the subdivider. The subdivider may make the changes recommended by the town commission and resubmit the final plat to the planning and zoning board and town commission in accordance with this section.
