§ 2-90. Provisions cumulative; authority to adopt additional requirements; effect of substantial compliance.

  • (a)

    The procedure as set forth in this division shall constitute a uniform method for the adoption and enactment of municipal ordinances and resolutions and shall be taken as cumulative to other methods provided by law for adoption and enactment of municipal ordinances and resolutions.

    (1)

    The town commission may by ordinance or Charter amendment specify additional requirements for the adoption or enactment of ordinances or resolutions or prescribe procedures in greater detail than contained in this division.

    (2)

    However, in no case may the town commission lessen or reduce the requirements of F.S. § 166.041 or other requirements as provided by general law.

    (b)

    Substantial compliance with the provisions contained in this division shall be a defense to an action to invalidate an ordinance or resolution for failure to comply with the provisions contained in this division.

    (c)

    Without limitation, the common law doctrines of laches and waiver are valid defenses to any action challenging the validity of an ordinance or resolution based on failure to strictly adhere to the provisions contained in this division.
