§ 50-37. Billing; delinquency; collection of unpaid charges.

  • (a)

    Billing. The date of utility billing may be established from time to time by the town commission based on the following rates established from time to time by the town commission for the following billable categories:

    (1)

    One thousand gallons or less of water.

    (2)

    Usage within the rationed limit.

    (3)

    Usage over the rationed limit.

    (4)

    Standard customer surcharge.

    (b)

    Delinquency; collection of unpaid charges.

    (1)

    Billing payments not received by the date set by the town commission will be deemed delinquent and a standard penalty charge will be assessed. The standard penalty rate shall be set by the town commission from time to time.

    (2)

    Bills remaining unpaid 45 days after the billing date may result in such sums being recovered by the town by suit in a court having jurisdiction of such case or by discontinuance of service of such utility until delinquent charges for services thereof are paid, including charges covering any reasonable expense for reconnecting such service after such delinquencies are paid, or any other lawful method of enforcement of the payment of such delinquencies.
